Bitwise CIO: Crypto Can Survive CLARITY Act Failure, Not the Wait

Bitwise chief investment officer Matt Hougan says the crypto industry can survive a failure of the CLARITY Act this week, but warns that it cannot thrive in a state of limbo. Hougan sees the bill’s odds as near a coin flip, yet argues that a single vote does not determine the industry’s fate.

Even if the bill fails, Hougan noted, the SEC is prepared to address the same issues through rulemaking. SEC Chair Paul Atkins used a July 31 speech to vow to bring the entire U.S. financial system onchain. Atkins’ Project Crypto initiative has already produced a Regulation Crypto rulemaking package for the agency’s 2026 agenda, covering token registration exemptions, a safe harbor for decentralizing projects, and broker-dealer custody and trading venues. Atkins described the package as a bridge to the CLARITY Act, capable of delivering much of the same certainty by rule rather than statute.

Hougan pointed to this shift as a key cushion for the market, contrasting it with the SEC’s posture two years ago. His larger argument is that the industry has outgrown any single bill. Stablecoins and tokenization, he says, have reached ‘escape velocity,’ meaning adoption will continue regardless of the Senate’s action. If the CLARITY Act passes, Hougan expects an immediate bull market; if it fails, he anticipates volatility but not the end of the cycle.

Not everyone at Bitwise shares that calm. The firm has separately warned that a failure could stall the 2026 crypto bull run by prolonging uncertainty. Prediction market traders have turned bearish on the bill’s chances, while some industry executives remain optimistic. Senate Majority Leader John Thune says he still expects a floor vote this week.
